THIS PRIVACY POLICY SETS OUT THE BASIS ON WHICH ANY PERSONAL DATA WE COLLECT FROM YOU, OR THAT YOU PROVIDE TO US, WILL BE PROCESSED BY US. PLEASE READ THIS CAREFULLTY BEFORE USING THE APP TO UNDERSTAND OUR VIEWS AND PRACTICES REGARDING YOUR PERSONAL DATA AND HOW WE WILL TREAT IT.

PRIVACY POLICY

WhadaTime are committed to protecting and respecting your privacy. This policy (together with our Terms of Use) applies to your use of:

  • The WhadaTime mobile application software (App), once you have downloaded or streamed a copy of the App onto your mobile telephone or handheld device (Device) .
  • Any of the services accessible through the App (Services) that are available on the App or other sites of ours (Services Sites), unless our Terms of Use (found on our website) state that a separate privacy policy applies to a particular Service, in which case that privacy policy only applies.

Data controller is WhadaTime.

WHO WE ARE

We WhadaTime (the platform) controlled by WhadaTime, LLC responsible for your personal data. If you have any questions about this privacy policy, including any requests to exercise your legal rights, please contact us using the contact details set out below.

We respect your right to privacy and will only process personal information about you in accordance with applicable data protection laws. We comply with General Data Protection Regulation (2016/679) and the UK Data Protection Act 2018. If any of these laws are replaced or superseded, we will also comply with that.

You have the right to make a complaint at any time to the Information Commissioner's Office (ICO), the UK supervisory authority for data protection issues (www.ico.org.uk). We would, however, appreciate the chance to deal with your concerns before you approach the ICO so please contact us in the first instance.

WHAT WE MAY COLLECT

Personal data, or personal information, is any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

We may collect, use, store and transfer different kinds of personal data about you when you use our Websites. Whenever we collect personal data about you, we must have a legal ground to do so. We will ensure that your person data is processed lawfully, fairly, and transparently without adversely your rights. The type of data we collect is as follows:

  • Information you give us (Submitted information). You may give us information about you by filling in forms on the App Site and the Services Sites (together Our Sites), or by corresponding with us (for example, by e-mail or chat). This includes information you provide when you register to use the App Site Services, download or register the App, subscribe to any of our Services, search for an App or Service, share data via the App and when you report a problem with the App, our Services, or any of our Sites Services. The information you give us may include your name, address, e-mail address and phone number, the Device's phone number, age, gender, username/channel name, password and other registration information, financial and credit card information, personal description and photographs. We use this information to perform a contract with you, i.e. to allow you to make use of our Sites and Services. We may require your payment details in order to allow you to make in-app purchase or donate sums of money to performers if you choose to do so.
  • Information we collect about you and your device. Each time you visit one of our Sites or use one of our Apps we may automatically collect the following information:
    • technical information, including the type of mobile device you use, a unique device identifier (for example, your Device's IMEI number, the MAC address of the Device's wireless network interface, or the mobile phone number used by the Device), mobile network information, your mobile operating system, the type of mobile browser you use, time zone setting, (Device Information);
    • information stored on your Device, including contact information, friends lists, login information, photos, videos or other digital content, check ins, (Content Information); and
    • details of your use of any of our Apps or your visits to any of Our Sites (including, but not limited to, traffic data, location data, weblogs and other communication data, whether this is required for our own billing purposes or otherwise) and the resources that you access (Log Information).
    • For any of your personal information being leaked by any individual other then WhadaTime; WhadaTime will not be responsible.
    We use this information for our legitimate interest, which is to provide you with the highest quality experience with using WhadaTime.
  • Location information. We may also use GPS technology or other similar technology to determine your current location. Some of our location-enabled Services require your personal data for the feature to work. If you wish to use the particular feature, you will be asked to consent to your data being used for this purpose.

    We use this information for our legitimate interest, which is to provide you with the highest quality experience with using WhadaTime.
  • Information we receive from other sources (Third Party Information). We are working closely with third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers) and may receive information about you from them. We use this information to perform our contract with you, so that you can experience our Sites and Services.
  • Unique application numbers. When you install or uninstall a Service containing a unique application number or when such a Service searches for automatic updates, that number and information about your installation, for example, the type of operating system, may be sent to us.

    We use this information for our legitimate interest, which is to provide you with the highest quality experience with using WhadaTime.

If you contact us, we may keep a record of that correspondence for our training purposes and to be able to serve you better next time you make contact.

We may process your data for compliance with a regulatory requirement or legal obligation to which we are subject to. Your data will only be processed if processing the data to comply with such obligation is a reasonable and appropriate way of achieving compliance.

We also collect, use and share aggregated data such as statistical or demographic data for any purpose. Aggregated data may be derived from your personal data but is not considered personal data in law as this data does not directly or indirectly reveal your identity. For example, we may aggregate your usage data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect aggregated data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this Privacy Policy.

COOKIES

We use cookies in accordance with the Privacy and Electronic Communications Regulations (implementing the EU Directive 2002/58/EC).

Our application uses cookies to distinguish you from other users of our application. This helps us to provide you with a good experience when you use our application and also allows us to improve our application. By continuing to use this application, you are agreeing to our use of cookies.

A cookie is a small file of letters and numbers that we store on your browser or the hard drive of your computer or device if you agree. Cookies contain information that is transferred to the hard drive of your computer or device.

We use the following cookies:

  • Strictly necessary cookies. These are cookies that are required for the operation of our application. They include, for example, cookies that enable you to log into secure areas of our application or make use of e-commerce services.
  • Analytical/performance cookies. These allow us to recognise and count the number of visitors and to see how visitors move around our application when they are using it. This helps us to improve the way our application works, for example, by ensuring that users are finding what they are looking for easily.
  • Functionality cookies. These are used to recognise you when you return to our application. This enables us to personalise our content for you, greet you by name and remember your preferences (for example, your choice of language or region).
  • Targeting cookies. These cookies record your visit to our application and the links you have followed. We will use this information to make our application and the advertising displayed on it more relevant to your interests. We may also share this information with third parties for this purpose.

Please note that third parties (including, for example, advertising networks and providers of external services like web traffic analysis services) may also use cookies, over which we have no control. These cookies are likely to be analytical/performance cookies or targeting cookies.

The third-party cookies we use are:

  • Google Analytics – this is a web analytics service provided by Google, Inc. The cookies used by Google Analytics help us to analyse how users use our website and to count the number of people who use it. Google Analytics stores your IP address anonymously. Google does not associate your IP address with any personally identifiable information.

We use third parties to provide analytics, advertising, payment processing and music services.

We will always ask for your consent to use non-essential cookies. You are free to withhold consent to this, but it means that we might not be able to provide the full App experience to you.

DISCLOSURE OF YOUR INFORMATION

We may disclose your personal information to any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 1159 of the Companies Act 2006.

We may disclose your personal information to third parties:

  • In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets.
  • If we or substantially all of our assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets.
  • If we are under a duty to disclose or share your personal data in order to comply with any legal or regulatory obligation or request.

In order to:

  • enforce or apply our Terms of Use and other agreements or to investigate potential breaches; or
  • protect our own rights, property or safety, or those of our customers or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

WHERE WE STORE YOUR INFORMATION

The data that we collect from you may be transferred to, and stored at, a destination outside European Economic Area (EEA). It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers. These staff may be engaged in the fulfilment of your request, order or reservation, the processing of your payment details and the provision of support services. By submitting your personal data, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy. We will also ensure that we have standard contractual clauses in place with these contractors before transferring data outside the EEA, and we will conduct regular due diligence on those contractors to ensure that they comply with the General Data Protection Regulation (2016/679). We will still be responsible for protection of your personal data, even where we have transferred it outside the EEA.

All information you provide to us is stored on our secure servers. Any payment transactions carried out by us or our chosen third-party provider of payment processing services will be encrypted using Secured Sockets Layer technology. Where we have given you (or where you have chosen) a password that enables you to access certain parts of our Sites, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to Our Sites. Any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

We may collect and store personal data on your Device using application data caches and browser web storage (including HTML 5) and other technology.

Certain Services include social networking, chat room or forum features. Ensure when using these features that you do not submit any personal data that you do not want to be seen, collected or used by other users.

We regularly review our data retention obligations to ensure we are not retaining data for longer to fulfil the purposes we collected it for, including the including for the purposes of satisfying any legal accounting, or reporting requirements.

YOUR RIGHTS

You have the right to ask us not to process your personal data for marketing purposes. We will usually inform you if we intend to use your data for such purposes or if we intend to disclose your information to any third party for such purposes. You can exercise your right to prevent such processing by checking certain boxes on the forms we use to collect your data. Our Sites may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates (including, but not limited to, websites on which the App or the Services are advertised). If you follow a link to any of these websites, please note that these websites and any services that may be accessible through them have their own privacy policies and that we do not accept any responsibility or liability for these policies or for any personal data that may be collected through these websites or services, such as contact and location data. Please check these policies before you submit any personal data to these websites or use these services.

You also have the following rights in relation to your personal data:

  • To request access to, deletion of or correction of, your personal data held by us at no cost to you. To request that your personal data be transferred to another person (data portability)
  • To be informed of what data processing is taking place
  • To restrict processing
  • To object to processing of your personal data
  • To complain to a supervisory authority
  • Right to withdraw consent

CHANGES TO PRIVACY POLICY

Any changes we may make to our privacy policy in the future will be posted on this page and, where appropriate, notified to you. The new terms may be displayed on-screen and you may be required to read and accept them to continue your use of the App or the Services.

The California Consumer Privacy Act of 2020 ( “CCPA” ) gives you the following rights.

    • The CCPA gives you the right to request that we disclose the specific pieces of personal information we have collected about you
    • Please see above for information on the data we collect on you, and how we process it
    • We do not sell your personal information. However, we do disclose your personal data to limited third parties, as described above
  • Right of deletion
    • You have the right to request that we delete your personal information, subject to certain exceptions
  • If you wish to delete your personal data, please use the “Delete my account” from settings and we will remove all your data. The entire deletion process might take up to 90 days. Please note that we may require certain information from you in order to verify your identity before proceeding with your request
